Terms of Service
I reserve the right to make changes to these terms at any time and are retroactive to previous works. Updated April 11, 2024.
Current turn-around time is varied. I cannot accept hard deadlines sooner than 90 days at this time.
Instructions
All commissions will need to have a form filled out to give you the best quote possible.For character paintings and chibi fill out this form for your full quote.For emotes, badges, and PNGtuber models, fill out this form for your quote.Please make sure to provide images of your character. For a custom design, please compile a document or send an accessible link with visual references and descriptions of what you would like. If I'm drawing from life or a real photo of someone, please include clear images of them for reference.I'm most comfortable with humans, chibis and kemonomimi (animal ears/tail). I can draw just about anything, but I cannot guarantee quality for requests outside of the scope of my previous work.I will send you a sketch as work in progress (WIP), and you can request any changes or reworks at that point. Small adjustments can be made at any time while I'm working on your commission. Major revisions during the rendering stage or after completion may be extra.Please feel free to contact me before commissioning to see if it's within my skill-set to complete if you are unsure. If a commission doesn't quite fit the options provided, you are also welcome to ask!

Payment
Only accepting $USD through Ko‑fi (Paypal or Stripe).Commissions can be paid 100% in full upfront or 50% upfront and 50% after sketch approval.
Full payments (100%) upfront are required for first-time clients.A non-refundable deposit will be charged at the time of payment as part of the total price for the artwork to reserve your slot for my services.Commission time starts after receiving payment. I'm consistently working on several projects at once, so please allow up to 90 days for completion. Large orders may take longer, depending on the work and size of the project.Because I'm charging you for both the artwork and my services, please be sure you know what artwork you need me to make for you before you order.I definitely want to make sure you are happy with my work, but I may need to charge extra during progress of the commission for work that falls outside of the original price.
Delivery
Artwork will be in PNG file format.All illustrations will be on a white background unless otherwise specified or advertised. Transparent backgrounds are reserved for commercial use only.Once everything is finalized and approved, I will send you a zip file of the artwork(s) to avoid image compression through uploading to Twitter/Discord/etc. If I have not received feedback from you within a reasonable amount of time, I will assume approval and send you the files as complete.Make sure you back up your files after I send them to you!
I'm a one-woman business, and time spent recovering files will need to be compensated with a $50 service charge to resend the commissioned artwork(s) to you.
Usage
The commissioned artwork is for personal, non-commercial use only, unless otherwise agreed upon at the time of payment.Removing or altering the artist signature is not permitted. Editing the artwork is not permitted. Cropping is okay as long as the artist signature is still visible and recognizable. Using or posting concept sketches, progress images or otherwise is not permitted. Using the artwork for something other than what we discussed at the time of payment is not permitted. This set of terms are to protect me, the artist and you, the buyer against art theft.See Commercial Use for details on how to use the artwork commercially. Commercial use rights are NOT full use rights. Using the artwork in other ways than what is agreed upon between you, the buyer, and myself, the artist, is not permitted. Examples include but are not limited to claiming the artwork is yours, repurposing and editing an illustration to make emotes, using emotes for anything other than emotes or printing for commercial resale when you did not buy those rights.Associating the artwork with cryptocurrency or NFTs or using the artwork to train "AI" programs or anything associated with generative AI is never permitted.Artwork is NOT for resale. Refer buyers to me for negotiation of use rights.Any violations of the aforementioned use of the artwork is grounds for me, the artist to strip you, the buyer from license to use the artwork without a refund. This means you will need to remove the artwork from your possession and my artwork will need to be removed from any online posts, emotes, VODs, videos, etc.All rights reserved to me, the artist, to publish the artworks online and offline for record-keeping and portfolio purposes as well as promotion for illustrative services and educational purposes through Ko‑fi memberships.
Credit given to me as the artist is highly requested and appreciated! If you want to credit me, link my respective account on that social media page or my Twitter: @LavaSlug as credit.
Commercial Use
Monetized streaming/broadcasting: You can use the artwork for your monetized streams and videos for an additional 20% of the total price for the artwork.Printing rights for commercial resale: You can sell the artwork on merchandise for a flat fee that is equal to 100% of the total price for the artwork. Note: broadcasting rights will be included in this option, and you will NOT need to pay both fees.If you would like to use my artwork that was not commissioned, including raffle prizes or free-to-use work, or you had commissioned for personal use at an earlier date, please contact me for commercial use fee.Waived for these types of commissions: Fees will be automatically waived for these commission options for monetized streaming only: emotes, badges, other custom icons for Twitch or live-streaming channel, PNGtuber models, profile pictures or banners for small businesses/self-employed.Commercial use rights are NOT full use rights. Using the artwork in other ways than what is agreed upon between you, the buyer, and myself, the artist, is not permitted. Examples include but are not limited to claiming the artwork is yours, repurposing and editing an illustration to make emotes, printing for commercial resale when you did not buy those rights, reselling the artwork for real money, cryptocurrency or as NFTs. Using the artwork to train "AI" programs is never permitted.
Refund Policy
All deposits are non-refundable.If I, the artist, need to cancel your order at any time, I will refund you in full if I cannot finish your commission.If you, the client, need to cancel the order before the artwork is complete, I will issue a refund minus the deposit.No refunds will be issued for completed works, even if you no longer want to use the artwork. As the artist, I reserve full discretion as to when artwork is complete.No refunds will be issued if I am unable to deliver the completed artwork due to being blocked or given incorrect information.No refunds for any violations of usage as described above.No refunds for commercial licenses will be issued after delivery of the artwork has been made.All cancelled commissions forfeit any use rights to the client(s), and I, the artist, will retain full rights to the artwork and any progress works, including sketches, WIPs and unused concepts.
Privacy Policy
Private and sensitive information is passively collected through payment transactions and correspondence. I will not purposefully give your private, identifying information to any third parties. I ask that you extend the same courtesy with mine. I might use your information for bookkeeping and tax purposes.Work and progress made on the artwork might be broadcasted live or posted online while I work on your commission. Please give me your tag if you want to be tagged on Instagram, TikTok or Twitter. If you do not want to be mentioned or have your art streamed, please let me know.

These terms are retroactive to previous works. By continuing to use commissioned artwork, you accept applicable changes.
